There is clear guidance in that H1-B petitioner seeking extension does not have to be the same employer that had filed (and approved) the I-140. Once you have an approved 140, anyone can extend your H1 for 3 years

I believe it is also illegal to work before getting a social security number. When you are on H4 you dont have a social security number (you have an itin which is not good enough for working). You will not get a social security number unless you have work authorization (i797). H1 will start only after october 1, so you can apply for social security number only after October 1 (i.e if you have i 797), it will take you about 4 to 7 weeks to get ssn. You can work only after getting the ssn. Somebody correct me if i wrong here.

I have contributed to IV in faxes, phone calls and sending numerous letters. You can always check my history before analyzing from a blind eye. I have been here for a while, I have even spoken to a few IV core members.
That being said, IV need's be more organized, blind actions and blind analysis wont get us anywhere.
It is the IV core members responsibility, I am aware of the challenges, but people are quiet frustrated and desperate for a change.
If IV is committed on its objectives, then organize a rally or a meeting with USCIS, I will be there.
Show the world what you are and stand for, not just talks should be the motto of this organization. Need my trust and money, please earn it.

Well, if we start to talk what is ethical and unethical. The entire immigration system and IT consulting is unethical.
That�s the down side from the client side on going for consulting and contracting. Every wise manager knows that! If every one were to hire full time, no matter H1B, EAD or PR, we wouldn�t be in the situation looking for a new assignment.
I agree that it is unethical on there part, but there is a much bigger unethical part on the part of the client companies for not hiring new grads and willing to train them in the areas of there business. New grad hiring doesn�t happen here as it happens in India.
Simply putting it, they don�t have a choice.
House wives with EAD�s and PR cards have started to get into contract jobs with 5-6 years of experience. Most of them are probably not even academically CS educated. Forget about the huge career gap they have.
No one, be it experienced or new grad likes to be code striped at client place, but for some one who is willing to take that risk of humiliation, I see nothing wrong in taking such a step to advance there career.
But there should be an optimal level that one should project them selves too in order to be accepted, can manage to get a decent time to learn things etc.
Also, client companies if they are serious should be more careful by calling for an on-site interview and testing them on the basics with a written test.

So whether you receive RFE, NOID depends on adjudicator instead of USCIS rules.
Yes. However, on the flip side, if the 140 withdrawel letter was dated within 180 days of 485 pending, your 485 will be denied no matter what RFE or NOID. Few good adjudicaters may send RFE in stead of NOID/direct denial.

Refiling labor and I-140 is an expensive affair and not everyone may be ready to shell out nearly $10k. Besides the time taken nowadays for labor and I-140 approval means that the conversion can happen only in about 12 to 18 months or so. The third variable is also the close scrutniy (read audit) that DOL is doing of EB2 labor applications. If people started conversions last year they should be good. But if someone plans to start it now, then I think it is a shot in the dark - however from an EB3 perspective, a shot in the dark may be better than no shot at all.

What do you conclude of this? Their has to be some rational reason behind them not moving EB2I, it is hard to grasp that they are still working on 2004-2005 PD's. Is their something we can do bring them in more transparency.

I am ok so far (as far as I know), but keep worrying about what could happen...I wish I had better control over my mind and did not worry about all the things that could go wrong....I have a 3 year old and at times when I am chatting to her my mind is running all over the world thinking of all the possible things that could go wrong...
I remember one of my friends once telling me when I told him about being worried about lay offs...he said...come on, that is like worrying about a earth quake....
Let us hope that things improve soon !!

If my dad was a green card holder and I was born outside USA, I could apply for the same thing as well. Why should I be limited to the per country quota?

And there is nothing wrong with that, right, because in the end you do not know what the financial situation of people on here is. One guy suggested a monthly contribution of 20 bucks, I laughed myself off the chair when I saw that. You're right, this is about "how not to pay" and why shouldn't it be. I don't make a lot, the lawyer's sucking me dry (in more ways than one if it were up to him), I've been waiting for this for ever, I have a family to support, etc.

Hi, Looks like you have a propabilities now.
1) If your H1 gets approved first before OCT'01st and your L1 does not approve, you should change to company B (who applied H1), if B applied your H1 with CHANGE OF STATUS (you will see new I-94 issued along with approval).
Good thing u can stay in country and work for B.
2) IF your H1 & L1 gets approved one after other in sequence, means first H1 then L1 then I think you are safe to work with company A without leaving country, Murthy.com says its the sequence that matters.
Check with Murthy.com attornies as well, but other Attorneys does not agree with them.It will be only problem when you apply GC, and not in mean while.
3)IF its L1 then H1,and if you want to work with company A, then you need to go out of country and get L1 stamped. Your H1 will remain avilable unless company B cancells it.
4) If your L1 gets approved and H1 gets problem(rejected I dont want this but if happens) then any how u can work for company A.
